1. Acceptance of Terms

These Terms and Conditions ("Terms") govern your use of services provided by Silken Hour, located at Sanduo 3rd Road, No. 94, Kaohsiung 806, Taiwan ("we," "us," or "our"). By booking an appointment, receiving our services, or using our website, you ("Client" or "you") agree to be bound by these Terms.

If you do not agree to these Terms, please do not use our services. We reserve the right to refuse service to anyone for any reason at any time.

2. Definitions

For the purposes of these Terms:

  • "Services" refers to all Thai massage and wellness treatments offered by Silken Hour, including but not limited to Signature Wellness Journey, Thai Herbal Steam and Massage, and Warm Herbal Compress Treatment.
  • "Client" refers to any individual who books or receives our Services.
  • "Practitioner" refers to our trained Thai massage therapists and wellness professionals.
  • "Agreement" refers to these Terms and Conditions together with our Privacy Policy.
  • "Premises" refers to our treatment facility at Sanduo 3rd Road, No. 94, Kaohsiung.

3. Eligibility and Age Requirements

You must be at least 18 years of age to book and receive our Services. By using our Services, you represent and warrant that you are 18 years of age or older and have the legal capacity to enter into this Agreement.

Minors under 18 may receive Services only with the presence and written consent of a parent or legal guardian who must remain on the Premises during the entire session.

4. Service Description

4.1 Nature of Services

Silken Hour provides traditional Thai massage and wellness services for relaxation and general wellbeing support. Our Services are not intended to diagnose, treat, cure, or prevent any medical condition.

4.2 Service Availability

Services are available during our published operating hours. We reserve the right to modify our hours, service offerings, or availability without prior notice.

4.3 Practitioner Assignment

While you may request a specific Practitioner, we cannot always accommodate such requests and reserve the right to assign Practitioners based on availability and scheduling needs.

5. Booking and Appointments

5.1 Booking Process

Appointments may be booked by phone at +886 7 694 0947 or through our contact form. All bookings are subject to availability and confirmation by us.

5.2 Confirmation

Your appointment is confirmed only when you receive confirmation from us via phone, email, or text message. We recommend arriving 10 to 15 minutes before your scheduled appointment time.

5.3 Late Arrivals

If you arrive late for your appointment, we will accommodate you if possible, but your session may need to be shortened to avoid delaying subsequent appointments. You will be charged the full service fee regardless of the shortened session time.

5.4 Cancellations and Rescheduling

We understand that schedules change. To cancel or reschedule an appointment:

  • Notice must be provided at least 24 hours in advance
  • Cancellations or changes made less than 24 hours before the appointment may be subject to a cancellation fee equal to 50% of the service price
  • No-shows (failure to appear for a scheduled appointment without notice) will be charged the full service fee
  • We reserve the right to refuse future bookings from clients with repeated no-shows or late cancellations

6. Payment Terms

6.1 Pricing

Current service prices are listed on our website and at our Premises. Prices are in Taiwan Dollars (TWD) and are subject to change without notice. The price in effect at the time of booking applies to your appointment.

6.2 Payment Methods

Payment is due at the time of service. We accept cash and major credit cards. Some services may require advance payment or deposit.

6.3 Refund Policy

Refunds are available under the following conditions:

  • If we cancel your appointment, you will receive a full refund or the option to reschedule
  • If you are dissatisfied with your service, please notify us immediately so we can address your concerns
  • No refunds are provided for appointments completed as scheduled
  • Requests for refunds due to dissatisfaction must be made within 48 hours of the appointment

7. Client Responsibilities

7.1 Health Disclosure

You must disclose any health conditions, injuries, allergies, or medications that may affect your ability to safely receive our Services. This includes but is not limited to:

  • Cardiovascular conditions
  • Recent surgeries or injuries
  • Pregnancy
  • Skin conditions or allergies
  • Joint or bone conditions
  • Any condition that limits mobility or flexibility

Failure to disclose relevant health information may result in injury and absolves us of liability.

7.2 Medical Consultation

If you have any health concerns, we recommend consulting with a qualified healthcare provider before receiving our Services. Our Services are not a substitute for medical care.

7.3 Communication During Treatment

You are responsible for communicating with your Practitioner about pressure, comfort, and any discomfort experienced during your session. Our Practitioners cannot read your mind and rely on your feedback to provide safe, comfortable treatment.

7.4 Conduct

Clients are expected to:

  • Treat our Practitioners and staff with respect and professionalism
  • Maintain appropriate personal hygiene
  • Refrain from inappropriate behavior or language
  • Follow our facility rules and Practitioner instructions
  • Not be under the influence of alcohol or illegal substances

We reserve the right to refuse or terminate service to anyone who violates these conduct standards, with no refund provided.

8. Disclaimer of Warranties

SERVICES ARE PROVIDED "AS IS" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED. WE DO NOT GUARANTEE SPECIFIC RESULTS FROM OUR SERVICES.

While our Practitioners are trained in traditional Thai massage techniques, individual experiences vary. We cannot and do not guarantee that our Services will:

  • Relieve specific symptoms or conditions
  • Prevent injury or illness
  • Produce particular outcomes or feelings
  • Be suitable for every individual

9. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY TAIWAN LAW, SILKEN HOUR, ITS OWNERS, PRACTITIONERS, AND EMPLOYEES SHALL NOT BE LIABLE FOR:

  • Any indirect, incidental, special, consequential, or punitive damages
  • Loss of profits, revenue, data, or use
  • Injuries or damages resulting from undisclosed health conditions
  • Injuries or damages resulting from failure to follow Practitioner instructions
  • Any damages exceeding the amount paid for the specific service in question

This limitation applies whether the alleged liability is based on contract, tort, negligence, or any other basis.

10. Indemnification

You agree to indemnify, defend, and hold harmless Silken Hour, its owners, Practitioners, employees, and agents from any claims, liabilities, damages, losses, or expenses (including legal fees) arising from:

  • Your violation of these Terms
  • Your failure to disclose relevant health information
  • Your violation of any rights of another person or entity
  • Your misuse of our Services

11. Intellectual Property

All content on our website and at our Premises, including text, graphics, logos, images, and software, is the property of Silken Hour or our licensors and is protected by Taiwan and international copyright laws.

You may not reproduce, distribute, modify, or create derivative works of our content without express written permission.

12. Privacy

Your privacy is important to us. Our collection and use of personal information is governed by our Privacy Policy, which is incorporated into these Terms by reference. Please review our Privacy Policy to understand our practices.

13. Termination

We reserve the right to terminate or suspend your access to our Services at any time, without prior notice, for any reason, including but not limited to:

  • Violation of these Terms
  • Inappropriate conduct toward our Practitioners or staff
  • Repeated no-shows or late cancellations
  • Non-payment of fees

14. Dispute Resolution and Governing Law

14.1 Governing Law

These Terms are governed by the laws of Taiwan. Any disputes arising from these Terms or our Services shall be subject to the exclusive jurisdiction of the courts in Kaohsiung, Taiwan.

14.2 Informal Resolution

Before pursuing formal legal action, we encourage you to contact us to seek an informal resolution of any disputes. Many concerns can be resolved through direct communication.

15. General Provisions

15.1 Entire Agreement

These Terms, together with our Privacy Policy, constitute the entire agreement between you and Silken Hour regarding our Services and supersede all prior agreements or understandings.

15.2 Severability

If any provision of these Terms is found to be unenforceable or invalid, that provision will be limited or eliminated to the minimum extent necessary, and the remaining provisions will remain in full force and effect.

15.3 Waiver

Our failure to enforce any right or provision of these Terms will not be considered a waiver of those rights.

15.4 Assignment

You may not assign or transfer these Terms or your rights hereunder without our prior written consent. We may assign these Terms without restriction.

15.5 Force Majeure

We shall not be liable for any failure or delay in performance due to circumstances beyond our reasonable control, including but not limited to acts of God, natural disasters, war, terrorism, labor disputes, or government actions.

16. Changes to Terms

We reserve the right to modify these Terms at any time. When we make changes, we will update the "Last Updated" date at the top of this page and may notify you through our website, email, or during your next appointment.

Your continued use of our Services after changes to these Terms constitutes acceptance of the modified Terms.
